Terms of Service

Modifications can be made to the TOS at our sole discretion without prior warning. Changes to any of our TOS does not constitute grounds for early contract termination or non-payment of services. Please check regularly for any updates.

The use of Jola Interactive's services constitutes acceptance and agreement to the TOS.

Acceptance Of Contractual Agreement:

  1. By placing an order and Jola Interactive's receipt of such order, Client agrees to our TOS.
  2. Client will purchase and pay for the services ordered and Jola Interactive will provide such services. Client acknowledges that they are aware of all applicable fees as per their order and/or any fees in the TOS.
  3. If Client's actual bandwidth usage in any month exceeds the allotted amount, Client will pay Jola Interactive any additional fees for upgrading to the next package level.
  4. Backups may or may not be made of your data. Shared accounts have their data backed up as a part of their service fee, VPS and Dedicated accounts may contract for a backup service. Clients may request a copy of any backups retained at any time, and will be provided with the most recent copy if automated retrieval methods do not already exist to the client within 24 hours of their request. Jola Interactive is not responsible for any data loss beyond the cost of services paid for any lost data whether backups are made or not. The client is always responsible for their data. Backup VPS plans are not backed up, and are not allowed to run any programs not intended to store or assist in the backup of clients data. Anyone found running programs not intended to store or assist in backup will be suspended and asked to cease, if they fail to, termination will follow.
  5. We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.
  6. Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or Usenet/newsgroups.
  7. Jola Interactive reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
  8. Jola Interactive reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of Jola Interactive (not to exceed $50.00).
  9. Accounts using shared resources will be suspended and notified at time of suspension if their usage disrupts the usage of others on that shared resource.
  10. Establishment of any services ordered is strictly contingent upon receipt of payment from Client to Jola Interactive. All subsequent payments are due on the same calendar date as service was ordered, paid for and established. Any setup fees must be paid at the time of the initial request of such services.
  11. Service will be interrupted on accounts that reach 7 days past due and any account that reaches 15 days past due will be terminated without recourse.
  12. Accounts that are not collectable by Jola Interactive will be turned over to an outside collection agency. Should your account be turned over for collection, you agree to pay Jola Interactive a processing and collection fee of not less than $50.00 nor more than $150.00.
  13. Any termination or suspension of services will not relieve Customer of responsibility for the payment of all accrued service fees, or any collection fees.

Account Cancellation:

All requests for canceling any service(s) must be made in writing. Confirmation receipt of your cancellation request will be sent within 24 hours.

Refunds And Disputes:

All billing disputes must be reported within 30 days of the time the dispute occurred. Disputed charges to your credit card issuer, also known as charge backs, will result in service interruption, and reconnection fees to restore the desired service. Refunds for shared hosting accounts will be given on a pro-rated rate based on the month's portion services will not be used. Refunds will be processed within 10 days of your account cancellation. No refunds will be made for dedicated servers. After cancellation, your site will no longer be able to be accessed at Jola Interactive.

To qualify for the 30 day money back policy, your account must be in good standing at the time of the request, no abuse complaints or spam reports have been lodged, no charge back or other payment disputes opened, and for the oldest account only. This is a one time offer for one account only.
